Hajjar C.G.K. Inc., doing business as CGK Realties ("CGK Realties", "we", "us", "our"), owns and manages residential rental properties in the Greater Montreal area. This Privacy Policy explains what personal information we collect through www.cgkrealties.com (the "Site") and our lead forms, how we use it, who we share it with, how we protect it, and what rights you have.

We handle personal information in accordance with the Act respecting the protection of personal information in the private sector (Quebec, as amended by Law 25), the Personal Information Protection and Electronic Documents Act (PIPEDA), and Canada's Anti-Spam Legislation (CASL).

1. Information We Collect

Information you give us directly:

Name (first and last)
Email address
Phone number, including mobile number if you enrol in SMS
Apartment preferences (unit size, desired areas, move-in timing)
Message content and inquiry details you submit through our forms
Communication records, including emails, texts, and call notes

Information collected automatically:

IP address, browser type, device type, and operating system
Pages visited, time on site, referring URL
Cookie and analytics identifiers

Information collected during a rental application:

If you proceed to a formal rental application, we collect additional information separately, including identity, employment, income, and rental history details. That process is governed by the application form and consent you sign at that time.

2. How We Use Your Information

We use personal information to:

Respond to your inquiries and match you with available apartments
Schedule and confirm apartment visits
Send you leasing, tenancy, and building communications
Send promotional messages about available units and offers, where you have consented
Process and evaluate rental applications
Maintain and improve the Site and our services
Keep records of consent as required by CASL and Law 25
Comply with legal, tax, and regulatory obligations

We do not use your information for automated decision-making that produces legal effects without human review.

3. SMS / Text Messaging

3.1 SMS program and how users opt in

Enrolment in our SMS program is express and opt-in only. You enrol by checking an unchecked SMS consent box on a form on this Site, on one of our Facebook Lead Forms, or on a paper or in-person form, and by providing your mobile number.

SMS consent is never required to rent an apartment, to submit an application, or to make any purchase. We do not use purchased, rented, or affiliate-sourced phone lists.

3.2 What we send and message frequency

Once enrolled, you may receive:

Leasing and inquiry follow-up: replies to your inquiry, unit availability, matching units
Appointment messaging: visit confirmations, reminders, reschedule notices
Tenant service and account messaging: maintenance updates, building notices, planned interruptions, rent and payment reminders
Promotional messaging: newly available units and rental promotions from CGK Realties

Message frequency varies. Message and data rates may apply based on your mobile plan. Carriers are not liable for delayed or undelivered messages.

3.3 How to opt out

To stop receiving messages, reply STOP to any text message. You will receive one confirmation message and no further texts. You may also opt out by emailing info@cgkrealties.com or calling (514) 399-9957. Reply HELP for assistance, or contact us at info@cgkrealties.com or (514) 399-9957.

Opting out of SMS does not affect your lease, tenancy, or application, and does not remove you from email or phone contact.

3.4 No sharing of mobile information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted.

All other use categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

The only parties that handle this data are the subcontractors and service providers that operate our messaging and support functions on our behalf, described in section 4. They act only on our instructions, may not use the data for their own purposes, and are contractually bound to protect it.

3.5 Consent records

We keep a record of when, where, and how you gave SMS consent, including timestamp and the form used, as required by CASL. You may request a copy of your consent record at any time.

4. Who We Share Information With

We share personal information only with service providers who need it to operate our business:

Wix (website hosting and forms)
HighLevel (CRM, messaging, appointment scheduling, marketing automation)
SMS and telecom carriers (message delivery only)
Meta / Facebook (lead advertising forms, where you submit through one)
Email delivery providers
Google Analytics (traffic and usage analytics; data may be processed on servers in the United States)
Professional advisors (accountants, lawyers) where required

We may also disclose information where required by law, court order, or a lawful request from a public authority, or to protect the rights, safety, or property of CGK Realties, our tenants, or others.

We do not sell your personal information. We do not rent or trade it. We do not share it with third parties for their own marketing purposes.

5. Cookies and Tracking

The Site uses cookies and similar technologies to keep the Site working, remember your preferences, and understand how visitors use the Site.

Essential cookies are required for the Site and its forms to function.
Analytics cookies, including Google Analytics, help us measure traffic and page performance in aggregate. Google Analytics may transmit and store your IP address on servers in the United States. Google does not associate your IP address with other data it holds.
Marketing and advertising cookies may be used to measure ad performance and show relevant ads on third-party platforms, where you have consented.

You can refuse or delete cookies through your browser settings. Blocking essential cookies may prevent parts of the Site from working. Where a consent banner is shown, you can change your choices at any time through that banner.

We do not currently respond to browser "Do Not Track" signals, as no common standard exists.

6. Data Security

We use reasonable technical, physical, and organizational safeguards to protect personal information, including:

Encrypted connections (HTTPS/TLS) across the Site and its forms
Access limited to authorized personnel on a need-to-know basis
Password-protected and access-controlled systems for CRM and messaging data
Service providers selected for their security practices and bound by confidentiality obligations
Periodic review of access rights and stored data

No method of transmission or storage is completely secure. If a confidentiality incident presents a risk of serious injury, we will notify affected individuals and the Commission d'accès à l'information as required under Law 25.

7. Data Retention

We retain personal information only as long as needed for the purposes described here:

Inquiries that do not lead to a lease: up to 24 months from last contact
SMS consent and opt-out records: minimum 3 years after consent is withdrawn, to demonstrate CASL compliance
Tenant and lease records: for the duration of the tenancy and as required by tax and civil law afterward

When information is no longer needed, we delete or anonymize it.

8. Your Rights

You have the right to:

Access the personal information we hold about you
Correct information that is inaccurate, incomplete, or ambiguous
Withdraw consent to marketing communications at any time, by email, by phone, or by replying STOP to a text
Request deletion of your information, subject to our legal retention obligations
Request portability of information you provided us, in a structured, commonly used technical format
File a complaint with us or with the Commission d'accès à l'information du Québec

To exercise any of these rights, contact our privacy officer below. We respond within 30 days as required by Law 25.

9. Children

You must be 18 years of age or older to use this SMS service. The Site and our SMS program are intended for individuals 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn we have, we will delete it.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The revised version takes effect when posted on this page, with an updated "Last updated" date. Material changes affecting how we use your information will be communicated directly where required by law.

11. Language

A French version of this Privacy Policy is published on the Site and is the official version. This English version is provided as a courtesy translation. In the event of any inconsistency, the French version prevails.
